1 Acceptance
By accessing or using the services provided by Housing Data Lab Ltd (“we”, “our”, or “us”), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, you must not use our services. We may update these Terms and Conditions from time to time. Continued use of the service following any updates constitutes acceptance of the revised terms.
2 The Service
Housing Data Lab Ltd provides:
- a software-as-a-service platform offering access to housing-related data, analysis, and reporting tools; and
- bespoke reporting and analytical services tailored to customer requirements
Our services are primarily based on datasets published by regulators and other publicly available sources. We may also incorporate data supplied by customers.
We reserve the right to:
- Modify, suspend, or discontinue any part of the service at any time
- Update or change the features and functionality of the platform
We do not guarantee that the service will be uninterrupted, error-free, or suitable for any particular purpose.
3 User Obligations
By using our services, you agree to:
- Provide accurate and up-to-date account information
- Maintain the confidentiality of your account credentials
- Use the service only for lawful purposes and in compliance with applicable laws and regulations
- Not misuse, interfere with, or disrupt the platform or its security
Where you provide data to us (including for bespoke reports), you confirm that:
- You have the right to share that data
- The data does not infringe any third-party rights
- The data complies with applicable laws and regulations
You further agree that you will not:
- Access or use the service for the purpose of building a competing product or service
- Copy, replicate, or imitate the functionality, design, structure, or user experience of the platform
- Extract, scrape, or systematically download data from the service beyond normal and intended use
- Attempt to analyse, deconstruct, reverse engineer, or benchmark the service in order to replicate its features, models, or underlying logic
- Use the service or any outputs from it to develop, train, or improve any competing data product, model, or service
You are solely responsible for how you interpret and use any outputs, insights, or reports generated by our service.
4 Intellectual Property
All intellectual property rights in the platform and services are owned by or licensed to Housing Data Lab Ltd. This includes, without limitation:
- the software and underlying code
- the design, layout, and user interface of the platform
- the structure, organisation, and schema of our data models and databases
- proprietary methodologies, transformations, and data processing techniques
- data visualisations, dashboards, and report formats
- branding, logos, and the overall “look and feel” of the service
You are granted a limited, non-exclusive, non-transferable right to use the service for your internal business purposes only. You may not copy, reproduce, distribute, modify, adapt, or create derivative works from any part of the service or its content, in whole or in part, without our prior written consent. For the avoidance of doubt, you may not replicate or recreate any aspect of the platform’s design, data models, visualisations, or functionality. Customers retain ownership of any data they provide to us. We do not claim ownership over customer-provided data.
5 Liability
To the fullest extent permitted by law:
- The service is provided on an “as is” and “as available” basis
- We make no warranties or representations regarding accuracy, completeness, or fitness for purpose
Housing Data Lab Ltd shall not be liable for:
- Any indirect, incidental, or consequential losses
- Loss of profits, revenue, data, or business opportunities
- Any decisions made based on the outputs of the service
Our total liability arising from or in connection with the service shall not exceed the amount paid by you for the service in the 12 months preceding the claim.
Nothing in these Terms excludes or limits liability for:
- Death or personal injury caused by negligence
- Fraud or fraudulent misrepresentation
- Any liability that cannot be excluded under applicable law
6 Bespoke Reporting Services
In addition to our platform services, we may provide bespoke reporting and analysis services (“Bespoke Services”), which may include data analysis, written reports, presentations, and delivery of outputs in digital or physical formats.
Scope of Work: Bespoke Services are provided based on the scope agreed with the customer. Any additional work outside that scope may require separate agreement.
Customer Data: Where you provide data to us for the purpose of Bespoke Services:
- you are responsible for ensuring the accuracy, completeness, and legality of that data
- we rely on such data as provided and do not independently verify it unless expressly agreed
Use of Outputs: Unless otherwise agreed in writing:
- reports and outputs are provided for your internal business use only
- you may share them within your organisation
- you may not publish, distribute externally, or provide to third parties without our prior written consent
Nature of Outputs and Recommendations: Our Bespoke Services may include analysis, insights, and recommendations based on available data and our professional expertise. However:
- such recommendations are based on the information available at the time, including any data provided by you
- we do not guarantee outcomes or results arising from implementation of any recommendations
- all decisions made based on our outputs remain your sole responsibility
- you are responsible for assessing the suitability of any recommendations in the context of your organisation’s specific circumstances
Our services do not constitute regulated financial, legal, or investment advice.
Intellectual Property: We retain all intellectual property rights in the methodologies, models, and formats used to produce Bespoke Services. You retain ownership of your underlying data.
Delivery and Presentation: Where presentations are provided (including to senior management or boards), they are based on the information available at the time and should be considered alongside your internal knowledge and judgement.
7 Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales.
Any disputes arising in connection with these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
